LEASE: A lease is currently in place allowing the Snyder Hunting Club (SHC) to use the Vancil Reservoir for both hunting and fishing. The lease was transferred from the previous owner of the property without any restriction or complication. Though the lease transfer is a reasonable possibility, it is NOT guaranteed, and bidders need to consider this when submitting bids.
DAMAGE: The Seller is disclosing that there is damage to ponds and land on the southeast corner of the property. Unusually heavy rains and flood water washed away at least one berm, which will need to be repaired in order to prevent future damage downstream to neighboring properties. It is unknown if any further remediation will be required. Determining the extent of remediation and cost of repairs will be the responsibility of the new owners. New owners will be solely responsible for any remediation that will need to be done and any associated costs. New owners accept full responsibility and liability for the property as-is. Prospective bidders must perform their own due diligence into the nature and extent of the damage, any water rights which may be effected, and the estimated costs to repair. Among other things, failure to repair the damage could possibly result in the water flow being reduced or stopped from the Vancil Reservoir, which is owned by the Riverside Irrigation District, and may result in the interruption of the water source to the property.

REQUIRED DEPOSIT(S) TO BID ON THE REAL ESTATE: All successful bidders will be required to wire the funds in the bid deposit amount of $15,000. In addition, for the successful bidder only, an additional wire will be due for the balance of Ten Percent (10%) of total contract price at the time the property is declared sold. For all other bidders, the wire refund for $15,000 will be initiated within 48 business hours following the completion of the auction.
10% BUYERS’S PREMIUM: A Ten Percent (10%) Buyer’s Premium will be added to the high bid on each property. The total contract price will be equal to the high bid plus the Buyer’s Premium.

HIGH BIDDER REQUIREMENTS: The high bidder will be required to place (10%) ten percent of the total contract price down and sign an Auction Real Estate Sales Contract through an electronic contract form called Docusign, immediately following the auction. Down payment shall be wired to the Auctioneer. The balance of the contract price shall be due from the buyer at closing. This auction is not contingent upon the buyer’s ability to obtain financing.
CLOSING: Closing shall be on or before Thirty (30) days for cash and Forty-five (45) day for financing, following the date of the auction. Possession shall be delivered to the buyer at closing. TAXES: The 2016 property taxes shall be prorated to the date of closing. Any previous year’s taxes due shall be paid in full by the seller at closing from their proceeds.
EASEMENTS AND LEASES: Sale of said property is subject to any and all easements of record and any and all leases.

AUCTION PROCEDURE: The Auctioneer shall at his sole discretion offer the property in any order, format, group or bid increment, which he determines is in the best interest of the Seller.
BROKER PARTICIPATION: A Two Percent (2.0%) Buyer’s Broker commission will be paid to any properly licensed real estate Broker who registers with the auctioneer before August 11th, 2016 AND represents a winning buyer, which successfully closes on the property. All commissions (including Buyer’s Broker Fees) shall be paid out of closing.
